1. Acceptance of Terms

By accessing or using Limawish ("the Service"), operated by abatalova, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Limawish is a wishlist management platform that allows users to create wishlists, track gifts, plan occasions, share wishlists publicly, and receive AI‑powered gift suggestions. The Service is available via web at limawish.com and through a mobile application.

3. User Accounts

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to use the Service.
  • You may not create accounts for the purpose of spamming, impersonation, or any unlawful activity.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

"User Content" means any information, text, images, links, or other materials you submit to the Service (including wishlist items, notes, and recipient details).

  • You retain ownership of your User Content.
  • By submitting User Content, you grant us a non‑exclusive, worldwide license to store, display, and process your content solely for the purpose of operating the Service.
  • You are responsible for ensuring your content does not infringe on any third‑party rights.
  • We may remove content that violates these Terms or applicable law.

5. Public Wishlists and Reservations

  • When you make a wishlist public, anyone with the link can view it.
  • Visitors may reserve items on public wishlists by providing their email address.
  • Reservations are non‑binding — they indicate intent to purchase, not a guarantee.
  • You can revoke public access to your wishlist at any time.

6. AI‑Powered Features

The Service offers AI‑powered gift suggestions using third‑party AI providers (currently Anthropic).

  • AI suggestions are provided "as is" and may not always be accurate or appropriate.
  • When you use this feature, relevant data (recipient information, wishlist content, gift history) is sent to the AI provider for processing. See our Privacy Policy for details.
  • We are not responsible for the quality, availability, or pricing of suggested products.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws.
  • Upload content that is defamatory, obscene, or harmful.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Use automated tools (bots, scrapers) to access the Service without our written consent.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the Service to collect personal information about other users without their consent.

8. Intellectual Property

The Service, its design, logo, and underlying code are the property of abatalova. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non‑infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error‑free.

10. Limitation of Liability

To the maximum extent permitted by law, abatalova shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

11. Termination

  • You may delete your account at any time through the account settings.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service. Your continued use after changes constitutes acceptance of the updated Terms.
